This privacy policy describes the collection of information by Gigi’s Cupcakes USA, Inc. ("Gigi’s," "we," or "us") from users of our Web sites at Gigicupcakesusa.COM and any other websites owned or operated by Gigi’s on which this Privacy Policy is displayed (each, a “Website,” and collectively, the “Websites”), and users of the various services we provide on the Websites (the “Services”), as well as our use and disclosure of that information. By using any of our Websites or our Services including our App (Gigi’s Rewards), you consent to the collection and use of information in accordance with this policy.

Personal Information

"Personal information," as used in this policy, is information that specifically identifies a person, such as a person's name, address, telephone number, or e-mail address. Personal information also includes information about a person's activities, such as information about his or her activity on our Website or our Services, and demographic information, such as date of birth, gender, geographic area, and preferences, when any of this information is linked to personal information that identifies that person.

Personal information does not include "aggregate" or other non-personally identifiable information. Aggregate information is information that we collect about a group or category of products, services, or users that is not personally identifiable or from which individual identities are removed. We may use and disclose aggregate information, and other non-personally identifiable information, for various purposes.

Collection of Information

Passive Information Collection

When you visit any of our Websites or use our Services, some information is automatically collected, such as your computer's IP address, browser type, system type, the content and pages that you access on the Website or Service, "referring URL" (i.e., the page from which you navigated to the Website), the pages from which you navigate to and from the Website or Service, and the time you spend on the Website or the Service.

We collect this information passively using technologies such as standard server logs, cookies, and clear GIFs (also known as "Web beacons"). We use passively-collected information to administer, operate, and improve our Websites, our Services, and our other services and systems, and to provide services and content that are tailored to you. Also, please be aware that third parties may set cookies on your hard drive or use other means of passively collecting information about your use of their services or content. We do not have access to, or control over, these third-party means of passive data collection.

For example, we may offer account registration, the ability to create and maintain user profiles, and the ability to post or share photographs, videos, and other content with other users of our Websites and our Services. We use personal information to provide services and information that you request; to enhance, improve, operate, and maintain our Websites, our Services, our APP(Gigi’s Rewards),  and our other systems and resources; to prevent fraudulent use of our Websites and our Services; to tailor your user experience; to maintain a record of our dealings with you, and for other administrative purposes.

We may also use personal information you provide to contact you regarding our products, services, and offers that we believe you may find of interest. We allow you to opt-out from receiving marketing communications from us as described in the “Choice” section below.

Disclosure of Information

We are not in the business of selling personal information about our users to third parties. We may disclose information about our users, including personal information, to third-party service providers (e.g., data storage and processing providers), that assist us in our work. We limit the personal information provided to these service providers to that which is reasonably necessary for them to perform their work for us.

We may also disclose information about our users, including personal information, if we believe that doing so is legally required or is in our interest to protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights or property of others.

As described below in the "Personal Information Available to Third Parties" section, personal information that you post or transmit to publicly-accessible areas of the Website or our Services, or to third-party services (each, a "Submission") may be available to third parties.

In addition, information about our users, including personal information, may be disclosed as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership, in which personal information could be transferred to third parties as one of our business assets.

Some features on our Websites may allow you to post or submit personal information that is made available to other users of our Websites and our Services, and to third-party services. If you post or submit information using these features, any personal information that you include with the post or submission will be made available to other users of our Websites and our Services, as well as to any users of third-party services to which the post or submission is directed. Additionally, we may use personal information that you have otherwise provided to us in connection with certain types of content, such as photographs and videos, that you post on the Website or provide to us for possible display on the Website. You include personal information in any posts or submissions using such features at your sole risk. Additionally, even in the event that information posted using such features may be removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information. Choice to opt-out

If you receive marketing or promotional communications from us, you may unsubscribe at any time by following the instructions contained within the message that we send. You may also opt-out from receiving marketing or promotional communications from us by sending us an email or by writing to us at the address given at the end of this policy.

Additionally, if you do not wish to be notified by email, postal mail, telephone, or text messages regarding products, services, events, programs, and offers that we believe you may find of interest, you may opt-out from such communications by sending us an email or by writing to us at the address given at the end of this policy. Even if you opt-out from marketing and promotional communications, you may still receive messages regarding any accounts you maintain with us, and regarding important updates to our Website or our Services.


For your convenience, our Websites and our Services may contain links to other Web sites, products, or services that we do not own or operate. If you choose to visit or use any third-party products or services, please be aware that this policy will not apply to your activities or any information you disclose while using third-party products or services or otherwise interacting with third parties.


Children's safety is important to us, and we encourage parents and guardians to take an active interest in the online activities of their children. We do not knowingly collect personal information from children under the age of 13 without obtaining parental consent.

International Visitors

Our Websites are hosted in the United States and are generally intended for United States visitors. If you visit from other regions with laws governing data collection and use that may differ from U.S. law, please be aware that you are transferring personal information to the United States. The United States does not have the same data protection laws as some other regions. By providing personal information to us, you consent to the transfer of it to the United States and the use of it in accordance with this policy.

Terms and Conditions

By registering for and participating in the Gigi’s Cupcakes USA Rewards program you acknowledge and agree to be bound by these terms and conditions ("Terms"). You may not participate in the Gigi’s Cupcakes USA Rewards program unless you understand and agree to these Terms.

These Terms apply to your participation in the Gigi’s Cupcakes USA Rewards promotional program ("Gigi’s Rewards") which is operated by Gigi’s Cupcakes USA, Inc. ("Gigi’s Cupcakes") in the United States of America. These Terms do not alter the terms or conditions of any other agreement you may have with Gigi’s Cupcakes USA for products, services, or other programs.
Gigi’s Rewards is a loyalty program designed to thank guests for patronizing our business. Members of Gigi’s Rewards can (1) earn and accumulate points ("Points") by making qualified purchases at qualifying Gigi’s Cupcakes USA locations that can be redeemed for certain menu items.  A "visit" is a qualified purchase of eligible menu items during an in-person or online order through Gigi’s Cupcakes USA website or Gigi’s Cupcakes App. Rewards may excluded if ordered through a third-party website. 

Program Changes

Gigi’s Cupcakes USA reserves the right to change these Terms or to eliminate Gigi’s Rewards at any time and in its sole discretion. Any changes or modifications will be effective immediately upon either (1) posting the revisions to and/or (2) notice to you via email to the email address you provide when registering for the program.


To participate in Gigi’s Rewards, you must be a resident of the United States and 18 years old or the age of majority in your state of residence. Gigi’s Rewards is not targeted towards or intended for use by minors.


Please read the Gigi’s Cupcakes USA Privacy Policy at which is incorporated into these Terms, to understand how Gigi’s Cupcakes USA collects, uses, and discloses information about guests, including through Gigi’s Rewards, and how to update or change your personal information and how we communicate with you.


There are three (3) ways to register 1) Through the Gigi’s Cupcakes USA Website – to register , go to and complete the online registration form. 2) Gigi’s Cupcakes App – to register download the Gigi’s Cupcakes App (links to iOS and Android) 3) In-bakery upon checkout – to sign up, provide the guest service person with your first & last name, phone number, and email address.

You may register for and use only one Gigi’s Rewards account. No membership card is required. You can reset your account password by following the instructions on the login page. If at any time you believe the Points showing in your account is inaccurate, please email us at


After you register, you will earn Points for qualified purchases (see list below). You cannot earn Points for purchases made or orders placed prior to registration. Points will be credited to your account ("Point Bank") up to 24 hours after your eligible purchase. You will earn Points for both in-bakery and online orders ( and Gigi’s Cupcakes USA App), and Rewards may only be redeemed through in-bakery, Gigi’s Cupcakes USA or Gigi’s Cupcakes USA App. Printed copy of your receipt or online order number required. Purchases made with complimentary codes, donation codes, and discount codes or through a third-party website may not be eligible for Points. Each eligible menu item purchase earns you 1 point for every dollar ($1) you spend. For currently eligible menu items and corresponding Points, see below:

After you register, you will earn Visits for qualified purchases (must spend a minimum of $1 to count as a visit). You cannot earn Visits for purchases made or orders placed prior to registration. Visits will be credited to your account ("Gigi’s Rewards") up to 24 hours after your eligible purchase. Additionally, visits must be a minimum of four (4) hours apart on a given day to receive credit for each visit. Any visit less than four (4) hours after the first visit in the same day will not count towards another visit, but you will still earn points for every dollar you spend.

Refer A Friend

When you refer a friend to the Gigi’s Rewards program, you will be eligible for ten (10) Points. To refer a friend, log in to your Gigi’s Cupcakes App go to the “More” then "Invite Friends" followed by "Invite".  To receive referral Points, your friend must (1) register for Gigi’s Cupcakes USA Rewards by following the link provided in your referring email, (2) visit a Gigi’s Cupcakes USA bakery, and (3) make a purchase of $1.00 or more. Your referral Points will be credited to your Point Bank 24 hours after your friend makes the qualified purchase. You will not earn Points for referring friends who are already registered for Gigi’s Rewards or who have already been referred by other Gigi’s Rewards members.

Points Accrual, Reward Expiration, and Exclusions

Points will be credited to your Gigi’s Rewards account approximately 24 hours after your Points-eligible purchase for purchases other than pre-orders and onsite private events. For pre-orders and onsite private events, points will be credited to your Rewards account approximately 7 days after an order is fulfilled. Accordingly, if you make a purchase eligible for Points on one day, you will not be able to use those Points until at least the following day or, in the case of pre-orders, the following week. Neither Points nor Rewards may be combined with other offers or promotions. Menu items eligible for Reward redemption may change from time to time. For menu items currently eligible for Reward redemption, see Terms & Conditions. Gift cards purchases are excluded from the program and are not eligible for Reward redemption. Once you redeem your Reward, your Rewards will reset, and that Reward will no longer appear in your Rewards. Purchases made prior to your registration for Gigi’s Rewards will not be eligible for Points or Rewards. Although you can earn Points from qualified online orders, you may only redeem Rewards in person at Gigi’s Cupcakes USA bakery or through Gigi’s Cupcakes App. Rewards may not be redeemed at special events or non-traditional bakeries. To redeem your reward in-bakery, scan your Gigi’s App at the POS or provide your number to your cashier when placing your order. To redeem your reward Gigi’s Cupcakes App, select the reward you want to use at checkout.

Emails from Gigi’s Cupcakes USA

Gigi’s Cupcakes USA may from time to time send you emails related to the Gigi’s Rewards program and other Gigi’s Cupcakes USA promotions. By registering for the Gigi’s Rewards program, you agree to receive such email.


There are no membership fees associated with Gigi’s Rewards. Points, Rewards, and other perks earned and accumulated in connection with the program are promotional and have no cash value. Your Gigi’s Rewards account is personal to you and may not be sold, transferred, or assigned to, or shared with, family, friends, or others. Gigi’s Cupcakes USA has the right to make the final determination of the Points, Rewards and other perks earned by you in its sole discretion. You may have only one Gigi’s Rewards account. Gigi’s Cupcakes USA reserves the right to terminate your account and/or your participation in Gigi’s Rewards if Gigi’s Cupcakes USA determines in its sole discretion that you have violated these Terms, you have more than one account, or that the use of your account is unauthorized, deceptive, fraudulent, or otherwise unlawful. Gigi’s Cupcakes USA may, in its sole discretion, suspend, cancel, or combine accounts that appear to be duplicative. Gigi’s Cupcakes USA also reserves the right to deactivate and make ineligible for the Gigi’s Rewards program any account that has been inactive for two consecutive years. Inactive is defined as no Points earned or visits. The Gigi’s Rewards program is governed by the laws of the State of California. AS A CONDITION OF PARTICIPATING IN THE PROGRAM, YOU AGREE THAT ANY AND ALL DISPUTES WHICH CANNOT BE RESOLVED BETWEEN THE PARTIES, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THIS PROGRAM, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, EXCLUSIVELY BEFORE A COURT LOCATED IN LOS ANGELES COUNTY, CALIFORNIA HAVING JURISDICTION. FURTHER, IN ANY SUCH DISPUTE, UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN AWARDS FOR, AND HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING ATTORNEYS' FEES, OTHER THAN YOUR ACTUAL OUT-OF-POCKET EXPENSES (E.G. COSTS ASSOCIATED WITH PARTICIPATING), AND YOU FURTHER WAIVE ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.
